General Terms and Conditions
1. Scope
The following terms and conditions apply to all orders placed via our online shop. Our online shop is intended exclusively for consumers.
Consumers are individuals who purchase goods or services for purposes that are not related to their commercial or professional activity.
2. Contractual partner, conclusion of contract, correction options
The purchase contract is concluded with APU KUNTUR GmbH.
By placing the products in the online shop, we make a binding offer to conclude a contract for these products. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process.
The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email.
3. Contract language, storage of contract text
The language(s) available for concluding the contract: German, English, French
We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Subject matter of the contract
4.1 Product description
The respective product description shall form an integral part of the contract.
4.2 Product images
Without prejudice to your statutory warranty rights, we would like to point out the following:
Due to individual screen configurations (e.g. resolution and brightness), slight deviations between the displayed and actual product colours may occur.
5. Delivery conditions
5.1 Delivery area
We deliver exclusively within Switzerland and the Principality of Liechtenstein.
5.2 Shipping costs
Standard shipping is free of charge for orders with a value of CHF 100 or more (incl. VAT).
5.3 Delivery options
We ship the products to the delivery address specified during the order process.

6. Payment
6.1 Prices
The prices stated at the time of ordering apply. These are total prices and include statutory VAT.
6.2 Payment methods
The following payment methods are generally available in our shop:
Credit card
By placing your order, you provide your credit card details. After verification as the legitimate cardholder, the payment transaction is carried out automatically and your card is charged. Your card is charged immediately after the order is placed.
PayPal
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22–24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, log in using your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. Further information is provided during the ordering process.
PayPal may offer additional payment methods to registered customers selected according to its own criteria. However, we have no influence on the availability of these options; any additional payment methods offered are governed solely by your contractual relationship with PayPal. Further information can be found in your PayPal account.
7. Retention of title
The goods remain our property until full payment has been received. We are entitled to make an entry in the retention of title register.
8. Warranty and guarantees
Unless expressly agreed otherwise below, the statutory warranty rights shall apply.
Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on specific information pages in the online shop.
You are required to inspect the condition of the received goods as soon as feasible in the ordinary course of business and, if defects are found for which the seller is liable, to notify us immediately. If you fail to do so, the goods shall be deemed approved, except for defects that were not recognizable during a proper inspection. If such defects appear later, notification must be made immediately upon discovery; otherwise, the goods shall also be deemed approved with regard to these defects. Notwithstanding the above, defects in items that have been integrated into an immovable structure in accordance with their intended use and have caused the defectiveness of the structure must be reported within 60 days. Defects that were not recognizable during a proper inspection must be reported within 60 days of their discovery.
You must return the defective product to us together with a detailed description of the defect. You bear the transport costs incurred. We shall provide warranty service by remedying defects. This shall be carried out, at our discretion, either by repair (rectification of the defect) or by delivery of defect-free goods (replacement). If subsequent performance fails, you are entitled to withdraw from the contract. This shall not apply in the case of insignificant defects. A right to price reduction is excluded. This exclusion of liability also extends to all claims competing with warranty rights, whether arising from contract (Art. 97 et seq. Swiss Code of Obligations), tort (Art. 41 et seq. Swiss Code of Obligations), avoidance of contract due to error (Art. 23 et seq. Swiss Code of Obligations), etc.
The following limitations and reductions of time limits shall not apply to claims for damages caused by us, our legal representatives or agents:
- in the event of injury to life, body or health
- in the event of intentional or grossly negligent breach of duty or fraudulent intent
- in the event of breach of essential contractual obligations, the fulfilment of which is necessary for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)
- within the scope of a guarantee, if agreed
or - insofar as the scope of application of product liability law is opened
For the purchase of used goods by consumers, the following applies: if the defect occurs after one year from delivery of the goods, warranty claims are excluded. Defects that occur within one year from delivery of the goods may be asserted within the statutory limitation period of two years from delivery.

9. Liability
We shall be liable without limitation for claims arising from damages caused by us, our legal representatives or agents:
- in the event of injury to life, body or health
- in the event of intentional or grossly negligent breach of duty
- in the event of guarantees, where agreed, or
- insofar as the scope of application of product liability law is opened
In the event of a breach of essential contractual obligations, the fulfilment of which is necessary for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), caused by slight negligence on our part, our legal representatives or agents, liability shall be limited in amount to the foreseeable damage at the time the contract was concluded, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

If individual clauses of these Terms and Conditions are wholly or partially invalid, the remainder of the contract shall remain valid. Where individual clauses are invalid, the content of the contract shall be governed by the statutory provisions.
